Justice Amit Sharma of the Delhi High Court on Monday recused himself from hearing the bail plea filed by Jawaharlal Nehru University (JNU) alumnus Umar Khalid in the Delhi riots conspiracy case. The matter was listed for hearing before a division bench of Justice Pratibha M Singh and Justice Amit Sharma. Justice Sharma had earlier recused himself from hearing the bail pleas filed by Sharjeel Imam, Meeran Haider and other Delhi riots accused.

Khalid was arrested in September 2020 and charged with criminal conspiracy, rioting, unlawful assembly as well as several other offences under the Unlawful Activities Prevention Act (UAPA) and has been in jail since then. This is his second bail plea. The trial court had first refused to grant him bail in March 2022. He then approached the high court, which refused to grant him relief in October 2022, prompting him to file an appeal before the apex court.
In May 2023, the Supreme Court sought a response from the Delhi Police in the case. His plea before the apex court was then adjourned 14 times. On February 14, 2024, Khalid withdrew his bail plea from the Supreme Court, citing change in circumstances. On May 28, the lower court rejected his second bail plea.
